Pokemon check their damage continuously. At ANY time that damage exceeds Hit Points, that Pokemon is K-O'd (this is NOT Magic, but many people are trying to turn it into Magic...) > 2. Sorry for your bad experiences, but I would suggest having this judge read the official online FAQ lists on Wizards website. This particular rule is clear on their website. If the judge refuses, just decide whether you really want to play tournaments under him/her. Brian Brokaw
